Inheritance and Succession of Mexican Real Estate for Foreigners

Review the deed, any trust beneficiary clause and applicable succession law. An existing foreign will or trust may affect the procedure; no universal timeline applies. Beneficiary designations should align with the title, estate arrangements and trustee bank’s requirements. Obtain the succession clause and review its effects before signing or changing beneficiaries.

Prepare a transfer of rights before it is needed

For a bank trust, obtain the substitute-beneficiary clause and the bank’s documentary procedure. For direct title, review the will and succession under applicable law. An overseas will alone does not establish that every Mexican formality has been met.

Reconcile names, shares and each beneficiary’s rights. Consider co-ownership, marital status and later changes. Ask the bank and notary for the case-specific documents and costs; a designation does not necessarily remove every succession procedure.
