What Happens If I Die Owning Mexican Property?
Inheritance of Mexican property depends on its title and any bank trust agreement. Substitute beneficiaries may facilitate a transfer of trust rights, but do not eliminate every succession requirement. Review identities, shares, supporting documents and estate instructions with the bank and Mexican notary before assuming that a transfer will be automatic.
Prepare a transfer of rights before it is needed
For a bank trust, obtain the substitute-beneficiary clause and the bank’s documentary procedure. For direct title, review the will and succession under applicable law. An overseas will alone does not establish that every Mexican formality has been met.
Reconcile names, shares and each beneficiary’s rights. Consider co-ownership, marital status and later changes. Ask the bank and notary for the case-specific documents and costs; a designation does not necessarily remove every succession procedure.
