Can Mexico Really Take Your Property? Separating Fact from Fear
Mexico recognizes private property and permits expropriation for public purposes with compensation under constitutional Article 27. A title dispute is a different issue. Before buying, separate an official taking affecting the parcel from fraud or contractual default, and have relevant decrees, registry records and the property file independently reviewed.
Separate two different legal problems
Expropriation requires a public-purpose basis and the applicable procedure. It differs from a seller lacking authority, a registered encumbrance or a dispute between private parties. Useful diligence first identifies the actual issue and the authority or party involved.
Before paying, obtain the notarial instrument, registry history and parcel identification. Have relevant decrees and restrictions reviewed. The constitutional rule does not establish that an individual property is risk-free, or justify a universal compensation amount or timetable.
